Terms and Conditions

1. These Terms apply to all contracts between Easy2Coach GmbH, Hufelandstraße 33, 10407 Berlin (“Easy2Coach”), and you concerning the use of the apps and purchases in the shop.
   • In these Terms, “the apps” means the web app at app.easy2coach.net and the apps Easy2Coach Team Manager, Easy2Coach Training and Easy2Coach Tactics for iOS and Android.
   • “The shop” means the shop on www.easy2coach.net, where you can buy subscriptions and other products.
2. Club Premium is only available together with the licence agreement for Club Premium. This also applies if you buy Club Premium in the shop. You can find the licence agreement on the product page in the shop. You conclude it on behalf of your club and warrant that you are authorised to do so. Club Premium is activated as soon as Easy2Coach has received the signed licence agreement. The licence agreement supplements these Terms and takes precedence over them where it provides otherwise.
3. If you buy a subscription in an app via the Apple App Store or Google Play, Apple or Google handles the purchase. Payment, renewal, cancellation and refunds are then governed by their terms. These Terms still apply to the use of the apps in this case.
4. The Data Processing Agreement (section 13) forms part of these Terms. Your own terms and conditions do not apply.

1. Anyone who uses the apps must be at least 16 years old or have the consent of their parents or legal guardians. This also applies if children and young people receive an account via an invitation from their team. Minors may only take out paid subscriptions with the consent of their parents or legal guardians.
2. Each person may only have one account. Your account is personal. You may not pass on your login details or share the account with others.
3. Keep the information in your account up to date, especially your email address. You are free to choose names for players and team members, including nicknames.
4. Keep your password secret.

1. Free account. When you register in one of the apps, you offer Easy2Coach a contract of use. Easy2Coach accepts it by activating your account.
2. Purchase in the shop. The products in the shop do not yet constitute a binding offer. You place a product in the shopping cart, enter your details at checkout and choose a payment method. Before submitting, you see all details at a glance and can correct input errors directly there. By clicking the button to place an order with an obligation to pay, you submit a binding offer. The contract is concluded as soon as Easy2Coach confirms the order by email or activates your product, whichever happens first.
3. Contracting party. Easy2Coach’s contracting party is the person through whose account a purchase is made. This also applies if the subscription is intended for an entire team.
4. Contract text. Easy2Coach stores your order and sends you the order details by email together with the confirmation. You can find your orders and invoices in your account on easy2coach.net. You can access and save these Terms on this page.

1. Basic membership. The basic membership is free of charge and not limited in time.
2. Premium plans. User Premium, Team Premium and Club Premium offer the same features. They differ in how many people and teams can use Premium. Tactics Pro is included in all Premium plans.
3. Tactics Pro. You can also book Tactics Pro on its own. It unlocks the Pro features of Easy2Coach Tactics.
4. Video storage. You buy additional storage for videos as a one-off purchase, without a subscription. You can distribute it among your teams in the app or use it yourself. It is available to you for as long as your account exists.
5. Digital training content. If you buy digital training content, for example training plans, you receive it in the version offered at the time of purchase.
6. Team Premium as a gift. When you complete the first setup steps in the app, Easy2Coach gives you 14 days of Team Premium. This period ends automatically.
7. What exactly a product includes is set out in the product description in the shop or in the app at the time of your order. You can get help via the contact form.

1. Easy2Coach continuously develops the apps further. In doing so, Easy2Coach may change, add, replace or remove features if there is a valid reason for doing so. Valid reasons include, in particular, improving the service, adapting to new technology or new versions of iOS and Android, security, changes in laws or in requirements set by Apple and Google, and the discontinuation of third-party services on which a feature is based.
2. Easy2Coach does not change purchased digital training content.
3. If you do not install an update offered, the app may no longer work fully.
4. Easy2Coach endeavours to keep the apps available around the clock. Maintenance, internet disruptions or outages at service providers may lead to interruptions.

1. The prices displayed in the shop at the time of your order apply.
2. You pay using one of the payment methods offered at checkout.
3. You pay for subscriptions in advance: on conclusion for the first term and thereafter at the beginning of each new billing period. For this purpose, Easy2Coach charges the means of payment you provided at the time of purchase.
4. You redeem vouchers at checkout. The terms applicable to a voucher are set out in its conditions.
5. If a payment is not made, Easy2Coach downgrades your account to the free basic membership and ends the subscription. Your data is retained.

1. Monthly subscription. The monthly subscription runs for one month and is automatically renewed for a further month each time. You can cancel it with effect from the end of the current month.
2. Annual subscription. The annual subscription initially runs for twelve months and is automatically renewed unless you cancel beforehand. It is billed one year in advance in each case.
   • If you are a consumer, the subscription continues for an indefinite period after the first twelve months. You can then cancel it with one month’s notice.
   • If you are a trader, the subscription is renewed for twelve months at a time unless you cancel no later than one month before it expires.
3. Subscriptions from the App Store or Google Play are cancelled in the settings of your Apple or Google account.
4. Club Premium. Term, renewal and cancellation are governed by the licence agreement. This also applies if you buy Club Premium in the shop.
5. How to cancel a subscription from the shop: via the “Cancel contracts here” button on easy2coach.net, in your account on easy2coach.net or in text form, for example via the contact form, using the email address of your account.
6. After a subscription ends you continue to use the apps with the free basic membership. You can then no longer use features that are only available with Premium.
7. Deleting your account. You can delete your account at any time and thereby end the basic membership. Your data is permanently deleted in the process (section 8, para. 5). This does not end an ongoing subscription. Cancel it separately. Via the contact form, Easy2Coach can assign an ongoing subscription to a new account.
8. Termination for good cause. Easy2Coach may terminate the contract without notice for good cause. Good cause exists in particular if, despite a warning, you materially breach these Terms, disseminate unlawful content, harm or harass other users or endanger the security of the apps. No warning is required in the case of serious breaches.

1. In the apps, you create your own content, for example exercises, training plans, drawings, animations, videos, images, files, events and messages.
2. So that the apps can work, you grant Easy2Coach the right to store your content, copy it, convert it technically (for example a video into another format or an animation into a video) and display it to the people with whom you share it in the apps. This right is non-exclusive, free of charge and limited to the operation of the apps. It ends when you delete the content. Backup copies are then overwritten in the usual cycle.
3. Only upload content for which you hold the necessary rights. If photos or videos show other people, you need their consent and, in the case of children, that of their parents, insofar as the law requires.
4. Your content is only visible within your team or to the people with whom you share it.
5. You can export the data of the individual features as a PDF at any time, for example for your own copies. Anything you delete in the apps is permanently deleted. This applies to individual content, to teams and to your account. Easy2Coach is not obliged to restore deleted data.

1. Comply with the law when using the apps. Prohibited in particular are offensive, discriminatory, violence-glorifying or pornographic content, content that infringes the rights of others, harassment of other users, and spam and advertising directed at other users.
2. Do not interfere with the technology of the apps. Do not exploit security vulnerabilities and do not circumvent restrictions, such as daily limits or the number of Premium users of a plan. Do not read out the apps automatically, for example with bots or scrapers, and do not systematically copy the exercise database.
3. The apps are not intended for medical documentation. For absences and injuries, only state what your team needs for planning. Diagnoses and medical findings do not belong in the apps.
4. If you culpably breach these rules, you are liable in accordance with the statutory provisions. If third parties assert claims against Easy2Coach as a result, you indemnify Easy2Coach against them and bear the reasonable costs of legal defence. This does not apply if you are not responsible for the breach.

1. If you find content in the apps that you consider unlawful, report it via the contact form. State where the content can be found and why you consider it unlawful. Give your name and email address and confirm that your information is correct to the best of your knowledge.
2. In the event of breaches of the law or of these Terms, Easy2Coach may remove or block content, warn you, temporarily suspend your account or terminate the contract.
3. The point of contact for authorities and users under the Digital Services Act is the contact form. You can write to Easy2Coach in German and English.

1. The apps and their content are legally protected. This also applies to the exercise database, training plans, templates, videos, graphics, symbols and pitch elements. For the duration of the contract, Easy2Coach grants you the non-exclusive, non-transferable right to use the apps within the scope of these Terms and your plan.
2. You may use Easy2Coach content, i.e. exercises, training plans, templates and videos, for your own training, your team and your club, and pass it on to your players and fellow coaches. You may not distribute it publicly, sell it or systematically incorporate it into a collection of your own. This also applies with a licence under para. 4.
3. You may freely use drawings and animations that you create with Easy2Coach Tactics or the drawing tools: in training, in your team and club, in messenger groups, on your club’s website and on social media, including in videos with which you generate advertising revenue. You may also show them in training sessions, courses and further education, even if these are subject to a fee, and stream them in online courses as long as the participants cannot download them. The reference to easy2coach.net in the image must remain visible.
4. You need a licence
   • if you hand out the drawings and animations to the participants or customers of a paid training offer, for example as a handout, course PDF or download in a learning portal (academy licence), or
   • if the drawings and animations are, or form the core of, a product that you sell or offer for payment, for example books, e-books, exercise collections or subscription content, and if you sell the drawings and animations themselves (publishing licence).
   The terms are set out in the licence agreement. You can request the licence via the contact form.
5. You may not use the name and logo “Easy2Coach” as your own mark.

1. Easy2Coach is liable without limitation for intent and gross negligence, for injury to life, body or health, within the scope of a guarantee assumed and under the German Product Liability Act.
2. In the case of slight negligence, Easy2Coach is only liable if a material contractual obligation is breached. This is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. Liability is then limited to the damage that was typically foreseeable at the time the contract was concluded.
3. For the free basic membership, Easy2Coach is only liable for intent and gross negligence. Para. 1 remains unaffected.
4. These rules also apply to Easy2Coach’s employees, representatives and vicarious agents.

1. How Easy2Coach processes personal data is set out in the Privacy Policy.
2. If you process data of other people in the apps, for example of players, parents or coaches, Easy2Coach processes this data on your behalf. The Data Processing Agreement applies to this. It forms part of this contract.

1. Easy2Coach may amend these Terms for the future if there is an objective reason for doing so. Such reasons include, for example, new laws or court rulings, new features or services, and gaps or ambiguities in the Terms. This only applies to changes that do not shift the balance between service and price to your disadvantage.
2. Easy2Coach will notify you of changes at least six weeks before they take effect, by email or in the app. If you do not object by the time they take effect, the new Terms apply. Easy2Coach will point this out to you in the notification. If you object, Easy2Coach may terminate the contract at the next possible date.

1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and live in another country, you retain the protection of the mandatory provisions of that country.
2. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.
3. The contract language is German. These Terms are also available in other languages. If the versions differ, the German version prevails.
